Please read these Terms of Use (“Terms”, “Terms and Conditions”) carefully before using any services or features of DotDotPlus mobile application (the “DotDotPlus”, the “Service”, the “DotDotPlus Service”). This is an agreement between Trigger Next Sdn Bhd (“we” or “We”, the “Company”), the owner and operator of DotDotPlus and users (“you” or “You”, the “user” or “the users”, the “User” or the “Users”) of DotDotPlus.
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms then you may not access or using the Service.
The Company may modify the Terms or Separate Terms when the Company deems necessary, without providing prior notice to you. The modification will become effective once the modified Terms are posted on an appropriate location within the website operated by the Company.
You will be deemed to have granted valid and irrevocable consent to the modified Terms by continuing to use the Service. You may refer to the Terms on a regular basis when using the Service, since a separate notification regarding the modification to the Terms may not be provided.
Subject to your compliance with these Terms, the Company hereby grants you permission to use the Service, provided that: (i) your use of the Service as permitted is solely for your personal use, and you are not permitted to resell or charge others for use of or access to the Service, or in any other manner inconsistent with these Terms; (ii) you will not duplicate, transfer, give access to, copy or distribute any part of the Service in any medium without the Company prior written authorization; (iii) you will not attempt to reverse enginner, alter or modify any part of the Service; and (iv) you will otherwise comply with the terms of use of these Terms and Privacy Policy.
In order to access and use the features of the Service, you acknowledge and agree that you will have to provide DotDotPlus with your mobile phone number. You expressly acknowledge and agree that in order to provide the Service, DotDotPlus may periodically access to your contact list and/or address book on your mobile device to find and keep track of mobile phone numbers of other users of the Service. You hereby give your express consent to DotDotPlus to access your contact list and/or address book for mobile phone numbers in order to provide and use the Service. You are aware that there is option to disable such periodically access to your contact list and/or address book on your mobile device.
You agree not to collect or harvest any personally identifiable information, including phone number, from the Service, nor to use the communication systems provided by the Service for any commercial solicitation or spam purposes. You agree not to spam, or solicit for commercial purposes, any users of the Service.
As a registered User to the DotDotPlus Service, you may delete your account and withdraw from using the DotDotPlus Service at any time. The Company may suspend or delete a registered User’s account without giving prior notice to the User if the Company believes that the User is violating or has violated the Terms of Use. The account cannot be retrieved even if Users have accidentally deleted their account, and the Company asks Users to be aware of this.
The DotDotPlus Service allows you to submit status text, profile photos, profile details and other communications submitted by you, as well as the automatic submission of your “last seen” or “online” status (the “User Profile”). These User Profile data may be hosted, shared, and/or published as part of the DotDotPlus Service, and may be visible to other users of the Service who have your mobile phone number in their mobile phone, who have granted your DotDotPlus user identity or any others format of the Service identity and which you have not expressly blocked.
The direct messages, photos, files, voices, location data, contacts that you send directly to other DotDotPlus users will only be viewable by those DotDotPlus user(s) or group(s) you directly send such information; but the User Profile may be globally viewed by DotDotPlus users that have your mobile phone number in their mobile phone, who have granted your DotDotPlus user identity or any others format of the Service identity, unless the user is blocked by you. Currently, there are limited options to set visibility of your User Profile. A good rule of thumb is if you don’t want the whole world to know something or see something, don’t submit it as a User Profile to the Service. You understand that whether or not such User Profiles data are published, DotDotPlus does not guarantee any confidentiality with respect to any User Profile data.
You shall be solely responsible for your own User Profile data and the consequences of posting or publishing them. The Service makes no guarantees as to the validity, accuracy or legal status of any User Profile data. In connection with User Profile, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant DotDotPlus all the license rights granted herein.
Information provided by you through the DotDotPlus Service or DotDotPlus Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. In addition, the Company will not and cannot censor or edit the content of any third-party websites or services.
You further acknowledge and agree that the Company shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.
We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.
Contents or other services offered by other business partners (the “Business Partners”) cooperating with the Company may be included within the Service. The Business Partners bear all responsibility regarding such contents and/or services offered. In addition, such contents and services may be governed by the explicit terms and conditions, which are set accordingly by the Business Partners.
The design of the DotDotPlus along with DotDotPlus created text, scripts, graphics, interactive features and audio, and the trademarks, service marks and logos contained therein (“Marks”), are owned by or licensed to the Company, subject to copyright and other intellectual property rights under Malaysia and foreign laws and international conventions.
The Service is provided to you AS IS for your information and personal use only. The Company reserves all rights not expressly granted in and to the Service. You agree to not engage in the use, copying, or distribution of any of the Service other than expressly permitted herein.
The Company may terminate or suspend access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
All provisions of the Terms, which by their nature should survive termination, shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
YOU AGREE THAT YOUR USE OF THE DOTDOTPLUS SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, DOTDOTPLUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF. DOTDOTPLUS MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SERVICE'S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVICE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE THROUGH THE ACTIONS OF ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONSIN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE DOTDOTPLUS SERVICE. DOTDOTPLUS DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE DOTDOTPLUS SERVICE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY USER STATUS SUBMISSION OR OTHER ADVERTISING, AND DOTDOTPLUS WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE. AND AGAIN, USE THIS JUST FOR FUN.
IN NO EVENT SHALL DOTDOTPLUS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR SERVICE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR SERVERS, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY, (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE DOTDOTPLUS CLIENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND/OR (VI) THE DISCLOSURE OF INFORMATION PURSUANT TO THESE TERMS OR PRIVACY POLICY. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION.
YOU SPECIFICALLY ACKNOWLEDGE THAT DOTDOTPLUS SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
You agree to defend, indemnify and hold harmless DotDotPlus, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the DotDotPlus Service; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your Content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of the DotDotPlus Service.
Children under the age of 16 are not allowed to use the DotDotPlus or the DotDotPlus Service as the DotDotPlus or the DotDotPlus Service is not intended for children under the age of 16. We do not knowingly collect Personal Identifying Information from any children under the age of 16 and we will promptly investigate (and remove) such Personal Identifying Information.
These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by the Company without restriction.
